The Board of Variance is an avenue for appeal of the interpretation and the strict application of certain local government provisions and regulations in specific circumstances defined in the legislation. It functions separately from the local government that established it and has its own authority under the Community Charter.
The Board of Variance performs its duties in accordance with the regulations outlined in Sections 901 and 902 of the Local Government Act.
In accordance with the Local Government Act, if the population of a municipality is more than 25,000, the Board of Variance for the municipality is to consist of 5 persons appointed by Council. In accordance with the Board of Variance Bylaw, members are appointed for a three year term.
Operations of the Committee
Meetings of the Board shall be held at the call of the Chair of the Board.
A hearing on a particular Appeal may take place at a meeting of the Board and shall be held not more than forty (40) days after the date of receipt of the Notice of Appeal unless an extension is allowed by the written consent of the Appellant.
A Notice of Meeting for each regular and special meeting of the Board shall be posted in the City Hall by the Secretary and the Board shall be convened by the Chairperson on the date and at the time and place set out in the Notice of Meeting.
All meetings shall be open to the public and the Board shall hear all representations made to the Board at a meeting.
The deliberations of the Board following the conclusion of representations shall not be open to the public.
Rules of Procedure
Meetings shall be conducted in accordance with the rules of procedure set out in the Council Procedure Bylaw and Committee System Policy.
